1. Agreement to Terms

By accessing and using the KakuTool website ("the Site") and purchasing Penholders, Notebooks, Paper Clips, or any other products ("Products"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our Site or services.

2. User Conduct and Orders

You agree to use the Site only for lawful purposes. When placing an order, you warrant that all information you provide is accurate and complete. KakuTool reserves the right to refuse or cancel any order at our discretion, including for reasons such as Product availability, errors in pricing or product description, or suspected fraud.

3. Intellectual Property Protection

All content on this Site, including but not limited to text, graphics, logos, images, product designs, and software, is the property of KakuTool or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. You may not modify, reproduce, distribute, or commercially exploit any material from this Site without our express written permission.

4. Limitation of Liability

To the fullest extent permitted by applicable law, KakuTool and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the Site or Products. This includes damages for lost profits, data, or goodwill. Our total liability for any claim arising from your use of the Site or Products shall not exceed the amount you paid for the Product(s) giving rise to the claim.

The Products are provided "as is" without warranties of any kind, either express or implied. KakuTool does not warrant that the Site will be uninterrupted, secure, or error-free.

5. Refund & Return Policy

We strive for your complete satisfaction. You may request a refund or return for Products under the following conditions:

• Defective or Damaged Items: Contact us at [email protected] within 14 days of receipt with details and photographic evidence. We will provide a prepaid return label and, upon confirmation, issue a full refund or replacement.
• Non-Defective Returns (Change of Mind): Unused Products in original packaging may be returned within 30 days of delivery. The customer is responsible for return shipping costs. A refund will be issued for the product price, excluding original shipping fees, once the item is received and inspected.
• Certain items, such as personalized Notebooks, may not be eligible for return unless defective. Please review specific product descriptions for details.

Refunds are processed to the original payment method within 10 business days after we receive the returned item.

6. Modifications to Terms and Service

KakuTool reserves the right to modify or replace these Terms at any time at our sole discretion. The most current version will be posted on the Site. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
